Ibn al-Mundhir (d. 241/855 - d. 318/930) was a prominent jurist known as Abu Bakr Muhammad ibn Ibrahim ibn Mundhir al-Nisaburi, who held a respected position among Islamic scholars. He authored works on the consensus of scholars (ijma) as well as valuable studies on disputed jurisprudential issues. Due to this characteristic, he has been referred to in the history of jurisprudence as "sahib al-khilafiyat" (the owner of differences). In addition to being recognized as one of the leading figures in the field of the science of differences (khilaf), Ibn al-Mundhir is also notable for being one of the first sources to produce detailed and extensive works on comparative jurisprudence. In his studies, he made it a principle not to adhere to a specific school of thought, but rather to draw upon various schools.
This study focuses on Ibn al-Mundhir's life, intellectual personality, teachers, students, and works, emphasizing his influence on the topics of consensus and disagreement. In our study, we aim to increase the recognition and benefit of this important figure, who is considered by some to be a scholar of absolute mujtahid status, and his written works within the academic community.
Born in Naysabur, Ibn al-Mundhir conducted research in various locations throughout his life and ultimately passed away in Mecca. While many of his works have been published, some are only mentioned in sources and are no longer accessible to us. Regarding the works he has written, there is currently only one study available based on classical sources titled "Ziyadat Abi Said al-Khirmi 'ala Kitab al-Ishraf li Ibn al-Mundhir al-Naysaburi." Additionally, there is a doctoral thesis titled "Imam Ibn al-Mundhir and Legal Thought" available today. Beyond these, we have not identified any other studies.
